Terms of Service

These Terms of Service (hereinafter referred to as the “Terms”) set forth the conditions for using the Android application “AlbumSorter” and its related websites (hereinafter collectively referred to as the “Service”) provided by Mekulog Operator Yumimura Hiro (hereinafter referred to as the “Operator”). By using the Service, users are deemed to have agreed to these Terms.

Section 1 (Applicability)

1. These Terms shall apply to all relationships concerning the use of the Service.
2. Any individual rules, guidelines, precautions, or other terms posted by the Operator on this Site shall constitute a part of these Terms.

Section 2 (Service Description)

1. The Service provides functions for organizing, backup support, and other related features for photo and video files.
2. The Operator may change, add, or delete the contents of the Service without prior notice.

Section 3 (Operating Environment)

Users shall, at their own responsibility and expense, prepare the devices, communication environments, storage devices, and any other environments necessary to use the Service.

Section 4 (Usage Fees)

1. The use of the Service shall be free of charge, except as otherwise specified by the Operator.
2. In the event that paid features are provided, such fees will be indicated separately on this Site or within the application.

Section 5 (Prohibited Matters)

Users shall not engage in any of the following acts when using the Service:

• Acts that violate laws, regulations, or public order and morals.
• Acts related to criminal behavior.
• Acts that interfere with the operation of the Service.
• Unauthorized access or attempts thereof.
• Analysis, modification, or reverse engineering of the Service.
• Acts that cause damages to other users or third parties.
• Any other acts deemed inappropriate by the Operator.

Section 6 (Intellectual Property Rights)

1. All copyrights, trademark rights, and other intellectual property rights related to the Service belong to the Operator or the legitimate right holders.
2. Users shall not use them beyond the scope permitted by laws and regulations.

1. Users shall bear full responsibility for managing photos, videos, and any other data managed by themselves.
2. It is highly recommended that users obtain separate backups of important data prior to using the Service.

Section 8 (Loss of Data, etc.)

The Operator shall not be liable for any damages arising out of the use of or inability to use the Service, including but not limited to:

• Loss of photo data
• Loss of video data
• File corruption
• Changes to folder structures
• Loss of data within storage devices
• Backup failures
• Any other damages related to data

Section 9 (No Guarantee of Operation)

The Operator does not guarantee that the Service will function properly on all devices, OS versions, SD cards, USB storage devices, or operating environments.

Section 10 (Modification and Suspension of the Service)

The Operator may modify, suspend, or terminate all or part of the Service without prior notice in any of the following cases:

• When performing system maintenance.
• In the event of system failures or disruptions.
• In the event of force majeure.
• In any other cases where the Operator deems it necessary.

Section 11 (Disclaimer of Warranties)

The Operator makes no warranties of any kind regarding the Service, including but not limited to:

• Accuracy
• Completeness
• Usefulness
• Continuity
• Fitness for a particular purpose
• Freedom from errors or defects

Section 12 (Limitation of Liability)

1. The Operator shall not be liable for any damages incurred by users in connection with the use of the Service, unless such damages are caused by the intentional misconduct or gross negligence of the Operator.
2. Even if the Operator is held liable, such liability shall be limited to the amount actually paid by the user to the Operator for the Service.

Section 13 (Third-Party Services)

1. The Service may utilize Google Play or other third-party services.
2. The Operator shall not be held liable for any damages arising from or in connection with such third-party services.

Section 14 (Modification of the Terms of Service)

1. The Operator may modify these Terms whenever deemed necessary.
2. The modified Terms of Service shall become effective at the time they are posted on this Site.

Section 15 (Governing Law and Jurisdiction)

1. These Terms shall be governed by and construed in accordance with the laws of Japan.
2. In the event of any dispute arising in connection with the Service, the court having jurisdiction over the location of the Operator shall have exclusive primary jurisdiction by agreement.
